1. Agreement Overview

These Terms of Service (“Agreement”) govern your use of ApexRDM’s digital marketing services. By engaging in any services provided by ApexRDM, you agree to the terms and conditions outlined below. ApexRDM reserves the right to amend these terms at any time, and it is your responsibility to review them regularly.

2. Services and Pricing Model

ApexRDM offers both one-time and monthly recurring digital marketing services. The pricing model is as follows:

• One-off Projects: All services are to be paid in full before the commencement of the project. Work will not begin until the payment has been received and cleared.

• Monthly Recurring Services: The initial payment includes a one-time fee plus the monthly recurring charge. The one-time payment will cover the setup or onboarding fees as outlined in the scope of the services. Monthly services will automatically renew unless otherwise stated by the client in writing prior to the next billing cycle.

3. Payment Terms

Payments must be made via the payment methods specified by ApexRDM. For one-off projects, full payment is required before the project commences. For recurring services, the first payment will include the one-time setup fee plus the first month’s service fee. Subsequent payments for recurring services will be processed monthly.

ApexRDM reserves the right to discontinue work or terminate the agreement if payments are not made in accordance with these terms.

4. 6-Month Guarantee

For services recommended by ApexRDM based on a thorough audit, we offer a 6-month guarantee under the following conditions:

• Doubling Results: We guarantee that your business will generate at least 2x the value of the investment you make with ApexRDM within 6 months of using our recommended services.

• Money-Back Guarantee: If we fail to meet the 2x guarantee, ApexRDM will refund the entire amount paid during the six months, plus an additional $1,500 as an apology for not meeting expectations.

The 6-month guarantee is only applicable to services recommended by ApexRDM based on our audit and does not apply to services that were not explicitly advised by us.

5. Client Responsibilities

Clients agree to:

• Provide timely access to necessary information, accounts, or assets required to carry out services.
• Respond to requests from ApexRDM in a timely manner to ensure project timelines are met.
• Comply with any additional terms outlined in the scope of work or project proposal.

Failure to comply with these responsibilities may result in delays or additional charges.

6. Refunds and Cancellations

• One-off Projects: Once payment has been made and work has commenced, refunds are not available unless ApexRDM fails to deliver the agreed-upon services as outlined in the scope of work.

• Monthly Recurring Services: You may cancel recurring services by providing written notice at least 15 days prior to the next billing cycle. Any work completed prior to the cancellation request will not be refunded.

7. Limitation of Liability

ApexRDM is not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of revenue or profit, arising from the use or inability to use the services provided, even if ApexRDM has been advised of the possibility of such damages.

8. Intellectual Property

Any work produced by ApexRDM, including but not limited to marketing materials, content, and strategies, remains the intellectual property of ApexRDM unless otherwise agreed upon in writing.

9. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary information disclosed during the project. This includes, but is not limited to, business strategies, marketing plans, and financial details.

10. Governing Law

This Agreement is governed by and construed in accordance with the laws of the state in which ApexRDM is headquartered. Any legal disputes will be handled in the jurisdiction of that state.

11. Acceptance of Terms
